When a large vehicle like a dump truck crashes into a small passenger vehicle, the end result can be very serious. Unfortunately, a recent collision on State Route 44 in Ohio turned out to be deadly for one man, along with the driver of the smaller vehicle suffering injuries in the crash.
The fatal accident occurred on the morning of Jan. 4 in Osnaburg Township, several hours outside Dayton, near the intersection of Orchardview Drive. A man was driving south on Route 44 when the driver of a dump truck allegedly turned left in front of him. The driver suffered injuries that do not appear to be life-threatening. He was taken to a hospital in Canton for treatment. His passenger, a 37-year-old man, died at the accident scene. It is believed that he was not wearing a seatbelt.
It is unknown if the dump truck driver, a 57-year-old man, suffered any injuries. Police are still investigating the accident. At this time, police do not believe alcohol was involved.
When a person is negligent and causes another's death through their actions - such as a fatal car crash - he or she could be sued by the victim's family for wrongful death. A loved one can file a wrongful death lawsuit if he or she is suffering financially due to the person's death. For example, a sudden death can cause unexpected bills and a loss of family income.
Whether or not the family of the 37-year-old man can claim damages in a wrongful death suit will depend on the results of the police investigation. If the dump truck driver is found to be liable for negligence, the victim's family may wish to preserve their legal rights by initiating a wrongful death lawsuit.
