It can be difficult for a family to deal with the loss of a loved one, especially when the person died due to someone else's negligence. An Ohio family is suing two men for causing a crash that killed their teen son.
The fatal accident happened on Faurot Avenue in Lima in May 2013. The victim, who was riding a motorcycle, was traveling east on Faurot Avenue when the other driver, traveling westbound, hit him as he was entering a driveway. The teen motorcyclist died from his injuries.
The wrongful death lawsuit, filed on behalf of the family by the administrator of the teen's estate, claims that the driver failed to yield the right of way and was driving in a negligent manner when the accident occurred. The victim's family is asking for damages in excess of $25,000. The lawsuit is asking for compensation for pain and suffering and funeral expenses. According to the family, the funeral alone cost $8,000.
The exact reason why the vehicle crashed into the motorcycle is unknown, but the reality is that numerous motorcycles are involved in crashes every year. They are smaller than passenger vehicles and, therefore, more difficult. This does not give motorists an excuse to cause accident, rather a reason to be extra vigilant when making turns.
If a loved one dies from a preventable accident, the survivors have the right to file a wrongful death lawsuit and attempt to seek damages, even if the accident was unintentional. Wrongful death claims can stem from virtually any type of accident, including car accidents. They can include a variety of damages, including economic and emotional damages.
