Families often pay hundreds of thousands of dollars to receive top-notch care for loved ones in nursing homes. However, the quality of care the residents receive is now always guaranteed to be top-notch. Sometimes residents are neglected or even abused, leading to serious injuries or even death. One woman is suing an Ohio nursing home after the staff's negligence allegedly led to the death of the man whose estate she is handling.
The facility, Baton Rouge Medical and Rehab Center, and 25 staff members have been sued for wrongful death. The man died in September of 2012 from the facility's alleged negligence. The lawsuit claims that the facility, located in Lima, did not properly train employees nor assess their competency in performing tasks. The woman is also alleging that the staff members provided a substandard level of care, which led to pressure ulcers and an infection.
The woman claims that the facility's failure to follow the man's personalized plan of care led to his death. She is suing for more than $250,000 in damages, which include loss of inheritance, mental anguish and loss of advice and companionship.
In a wrongful death case, there are many factors that can affect a plaintiff's damage award. These include the victim's age, life expectancy, earning capacity and overall condition. If the nursing home is found liable for the man's death, it could be forced to pay the woman damages. There are both financial and emotional damages to consider in any wrongful death situation. The most common financial damages would be medical and funeral expenses, while emotional damages may include mental anguish or loss of companionship.
