Ohio man to receive workers' compensation after employer dispute

There are strict requirements for claimants looking to receive Social Security Disability benefits after a serious injury or illness. Those who argue with their employer and then proceed to quit their job typically won't qualify for such benefits.

An injured Ohio man learned this the hard way after he became upset over a misunderstanding with his employer that ended up involving the police in the dispute. The man quit his job and was denied disability benefits as a result. He was, however, approved for workers' compensation benefits.

According to reports, the man, a truck mechanic for Wingate Transport Inc., was injured on the job in June 2009 during a grease seal replacement. Five days later, he was diagnosed with a strain to the left sacroiliac joint. About a week later, he was released by his doctor to perform light-duty work.

The company owner confirmed that the man could return to work, but also asked that the man return his Jeep. The man had been borrowing the owner's jeep for six months because his own vehicle was involved in an accident and ended up being totaled.

The man was upset about this request and asked if he was being fired. The owner said no, he just wanted his vehicle back. The man started loading up tools and equipment into a pickup truck. The owner asked him to stop, but the man refused until police arrived at the scene. The man finally complied and left the jobsite. He voluntarily ended his employment.

The man filed for temporary-total-disability benefits, but was denied because he quit his job. He was granted workers' compensation for the sacroiliac joint injury, even though the employer tried to dispute the claim.

While those who are injured in the workplace are entitled to workers' compensation benefits, obtaining disability benefits is much more difficult. Quitting a job after a dispute with an employer is certainly not the way to go about it. Those dealing with a similar situation should understand their options and legal rights. This could help ensure they take appropriate action.
