There are many different ways that workers in Ohio are protected in the event that they are injured on the job. In a previous post regarding workers' compensation benefits, this blog discussed temporary total compensation, and the amount of money that an injured worker can receive. There are also other types of compensation that a work accident victim can receive. If, for example, a worker is able to take part in an approved rehabilitation plan, and the worker intends to return to work, the worker can receive living maintenance compensation.
An injured worker can receive wage loss compensation in two situations. One is if the worker found employment that is different from the kind of work that they did before, and the worker receives less in pay than what they received at the time of the injury. The other is if the worker cannot find work that is allowable under the medical restrictions that they have. It is possible that a worker can receive what is known as a living maintenance wage loss compensation by completing a rehabilitation program and forging a successful return to work with a wage loss in comparison to the wages that they earned before.
A worker can also receive permanent total disability or statutory permanent total disability. This can occur if the Industrial Commission of Ohio decides that the worker is permanently disabled. The worker is not allowed to go back to work while simultaneously receiving payments for total disability. But, it is possible to return to work if the worker gets statutory permanent total disability.
Workers' compensation claims can be complicated and there are numerous different ways in which a worker who was injured on the job can receive assistance. However, given the different rules that are in play and how they vary depending on the extent of the injuries the work accident victim suffered, it is important to have an understanding of the law.
